Terms of Service

These Terms of Service (“Terms”) govern your use of spskyway.com and any other website, application, or interface operated by Jacob Ramos (collectively, the “Service”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptable use

The Service is provided for your personal, non-commercial use to navigate, discover, and report information about the St. Paul skyway system. You agree to use the Service only for that purpose and in compliance with applicable law.

2. Prohibited conduct

You may not, and you may not authorize or assist anyone or anything acting on your behalf to:

  • access, copy, harvest, scrape, mirror, or extract any part of the Service or its underlying data through any automated means, including bots, crawlers, scrapers, headless browsers, or any other software or process designed to mimic or replace a human user;
  • access, query, or use any of our application programming interfaces (including but not limited to /api/data, /api/directions, and /api/sensors) from outside the Service itself, except through the Service in a normal interactive browser session;
  • bulk-download, archive, mirror, syndicate, or build a derivative dataset from any content on the Service;
  • use any content from the Service to train, fine-tune, evaluate, benchmark, or otherwise develop any machine-learning or artificial- intelligence model, dataset, or product;
  • use any content from the Service to seed, populate, or operate a competing directory, navigation product, or location-based service;
  • reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying ideas of the Service;
  • bypass, disable, or interfere with any access control, rate limit, authentication, or other security or integrity feature of the Service;
  • impersonate another person or business when submitting a claim, feedback, or any other content;
  • use the Service in a manner that imposes an unreasonable load on our infrastructure or that of our service providers.

3. Intellectual property

The directory, building registry, navigation steps, photographs, writing, design, code, and other content we have created or curated on the Service are © Jacob Ramos, all rights reserved. Underlying map geometry sourced from OpenStreetMap is licensed under the Open Database License (ODbL) and remains the property of OpenStreetMap contributors. Our names, logos, and brand elements may not be used without our prior written permission.

4. Your submissions

When you submit a business claim, suggested hours, an issue report, or any other content to the Service, you grant us a perpetual, worldwide, royalty-free, sublicensable, and irrevocable license to use, store, reproduce, modify, display, and distribute that content as part of operating and improving the Service. You represent and warrant that you have the right to grant this license and that your submission does not infringe the rights of any third party.

5. Termination and enforcement

We may block, throttle, suspend, or terminate your access to the Service at any time and for any reason, including any actual or suspected violation of these Terms, with or without notice. We reserve all rights and remedies available to us under the U.S. Computer Fraud and Abuse Act, the Digital Millennium Copyright Act, the Minnesota Computer Crime Act, contract law, copyright law, and any other applicable law.

6. No warranty

The Service is provided “as is” and “as available” without warranty of any kind, express or implied. Business hours, locations, navigation steps, photographs, and other information may be inaccurate, incomplete, or out of date. You are responsible for verifying anything important to you. We do not warrant that the Service will be available, uninterrupted, or free from error.

7. Limitation of liability

To the maximum extent permitted by law, our total cumulative liability arising out of or relating to the Service or these Terms is zero dollars (US$0). We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, even if advised of the possibility.

8. Governing law and venue

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Ramsey County, Minnesota, and you consent to the personal jurisdiction of those courts.

9. Changes

We may update these Terms from time to time. The current version is always available at spskyway.com/terms. Your continued use of the Service after a change is posted constitutes your acceptance of the updated Terms.
